COMPENSATION FOR PERSONAL DAMAGES RESULTING FROM THE EXPLOITATION OF DEGRADING LABOR ANALOGOUS TO SLAVERY

VIOLATION OF PERSONALITY RIGHTS AND ASPECTS OF CIVIL LIABILITY

Abstract

The article aims to investigate tort liability arising from labor conditions analogous to slavery, with a particular focus on non-material damages. In this context, civil liability can be understood as the obligation to compensate for the harm caused to fundamental and personality rights, with special emphasis on violation of human dignity resulting from labor exploitation under degrading conditions. Civil liability acts as a protective mechanism against abuses and violations of human rights. Its application in cases of labor analogous to slavery requires an in-depth analysis of the limits of private autonomy in employment or service contracts and the extent of protection of personality rights, such as dignity, freedom, and equality. These rights are intrinsically linked to the prohibition of any form of forced or slave-like labor, which, when identified, imposes on the employer the duty to compensate the worker for the harm suffered. Additionally, the "dirty list" and the publicity of agents involved are essential elements for understanding civil liability in this context. Making public the names of companies that engage in such practices has a deterrent effect, acting as a form of social control and preventing the continuation of this exploitation. This study employs a deductive method, primarily through a bibliographic review of articles and books on the subject.
