The environmental legal interpretation for a new hermeneutics in the rule of law in Cuba

The Cuban Constitution promulgated in April 2019, proclaims the Socialist State of Law in Cuba, where the environmental dilemma is inserted in the constitutional iter. Environmental legal hermeneutics has never been a subject analyzed within the academy in Cuba. The principles of not causing considerable damage or harm, "do not significant harm", the existential minimum and environmental progress, in the face of shortcomings and none in environmental application and compliance, are outlined. In this new constitutional order that presupposes an approach from the local, the legal operator stands before a reflexive point of support, to comply with the environmental assignment, his obligations and responsibilities. The new environmental legal hermeneutics, anoints its principles, in order to become a system of legal interpretation to be developed, as essential protection and citizen guarantee, in the climatic, urban planning and decentralized autonomous ecological systems, for socio-spatial justice.
