Post-industrial society is called a risk society because of the risks generated by the advance of technology, globalization and the flow of information. In this new context, civil liability, especially that resulting from unjustly sustained damages, takes on the dimension of the community. Thus, the problem faced in the research is to analyze, according to doctrine and jurisprudence, the possibility of conferring moral damages to a collectivity. The methodology employed was the search for specific articles on the subject, as well as judgments of the courts combined with current doctrine. The conclusion is that the collective labor moral damage exists as a result of the risk society and that affects in particular the work environment and therefore the health of the worker, this causes the debate to deepen the environmental law of labor. and that it be seen as an instrument to reduce complexities, serving as a mechanism for protecting workers' health.
