Contemporary contract law: tradition, perspectives, and challenges

Abstract

The narratives of the crisis in Law are constant. In the realm of Brazilian Contract Law, whether or not there is a crisis, it is certain that new phenomena demand a readjustment of classical institutes to meet new social needs. This seminal article aims to seek support to identify the nodal points of contemporary Brazilian Contract Law. To this end, it is argued that the study of the Romano-Germanic legal tradition is essential to understand current transformations, constituting a necessary starting point for its examination. Furthermore, it is noted that contemporary perspectives of colonization, recodification, and updating of Private Law in general are reflected in Contract Law and should be considered by the jurist engaged in its investigation. It is concluded that to identify the right questions in the realm of Contract Law, it is necessary to resort to the issues that are the object of the creative action of economic agents and the legal professionals in contractual practice, as these are capable of identifying the paths for effective evolution and systematization of contemporary Contract Law.
