O direito de não saber e o privilégio terapêutico na relação médico-paciente idoso

Abstract

This article analyzes the possibility of exercising the right not to know and applying the therapeutic privilege to elderly patients. In order to achieve the intended object, autonomy and information are examined as fundamental elements of the doctor-patient relationship, passing through concepts such as autonomy, the patient's right to information and informed consent. In addition, when and how the therapeutic privilege and the right not to know occurs, as exceptions to the doctor's duty to inform, are analyzed,  The vulnerability of elderly patients is also investigated and guidelines are suggested to apply the therapeutic privilege and exercise the right not to know properly, especially when it involves elderly people. It is added that research was predominantly bibliographic and qualitative in nature, through the interpretation and evaluation of the intended object, as well as the method consisted of the hypothetical-deductive, through the falsification of hypotheses. It is noteworthy that this is an issue of undoubted relevance as it seeks to examine institutes that aim to ensure the autonomy and well-being of patients who are in a situation of greater vulnerability.
