Compulsory drug licensing in the COVID-19 pandemic: an approach from Law and Economics

The COVID-19 pandemic has imposed several difficulties on health and the world economy. In this sense, the fight against the virus has assumed global prominence and the discovery of a vaccine and / or remedies to fight it has been pursued by large pharmaceutical companies, which, in addition to human causes, pursue a prominent position in the sector's competition. The high investments in new technologies and in new research are made possible especially by the security and exclusivity of economic exploitation that the patent system guarantees to the owner of the invention. However, the pharmaceutical industry can be governed by other maxims, since, aiming at the need to guarantee the maximization of access to medicines and the Right to Health, the pantentary system can be made more flexible through compulsory licensing. Thus, using a dialectical approach, and under Law and Economics precepts, it is intended to understand and examine the conflict between the property right related to the registration of a patent for a drug and its exploitation, and the common interest society, especially regarding the existence of a social interest in providing essential medicines. Likewise, using the theory of Joseph A. Schumpeter, it is intended to investigate the impacts that these institutes can generate economically, influencing negatively or positively economic development.
