A QUESTÃO DA ARBITRAGEM À LUZ DO REGRAMENTO JURÍDICO BRASILEIRO JURISDIÇÃO OU EQUIVALENTE JURISDICIONAL

Considering the increasing jurisdictional demand, the Judiciary, with the autorization of the legislator, iniciated a process of search and incentive for conflit resolution methods aimed at reducing the solution to disputes by the direct figure of the Judge.
From this State's impulse emanate methods called “jurisdictional equivalents”, which, in short, are non-jurisdictional ways of resolving conflicts, but with attention to the requirements of the State. From this perspective, the present study will approach arbitration and its existential relationship to the jurisdiction itself or to the “jurisdictional equivalents”, a point of great dissent in Brazilian doctrine.
Therefore, in the development of this work, we will approach the conceptualization of jurisdiction and methods equivalent to this, through the analysis of the studies of brazilian’s processualist authors. The second chapter observes the conceptualization and the characteristics of the arbitration, as well as its procedure and its relation with the outlined in the jurisdicional’s topic. In the third, finally, an analysis will be made in order to conclude whether the arbitration holds the points closest to the “jurisdictional equivalents”, or to the jurisdiction, here understood as private.
