Sistemas jurídicos comparados: el trust inglés y el fideicommissum romano
Resumo
O objetivo deste trabalho é analisar a instituição do trust, bem como o fideicomisso romano, por ser peça chave na criação e evolução da figura do Common Law. Concretamente, analisaremos as origens do trust, sua natureza e seu funcionamento, tomando como base o fideicomisso romano. Posteriormente, faremos uma pequena análise sobre as semelhanças e diferenças entre ambas as figuras. Conclui que o fideicommissum e o trust são institutos que servem ao mesmo fim, mas o trust moderno adquiriu uma multiplicidade de peculiaridades próprias, afastando-se da figura romana, mas preservando a mesma estrutura e função: a transmissão de um bem, com base de acordo com a Fides, a um terceiro para gerenciá-lo em benefício de outros.
