OS CICLOS DO CONSTITUCIONALISMO ECOLÓGICO
Resumo
A questão ambiental ingressou no temário das Constituições apenas no final do século XX. Desde então, tem passado por um rápido processo de universalização e de “densificação” normativa. Os ciclos constitucionais evoluíram de proclamações retóricas ou programáticas da proteção ambiental ao reconhecimento de um direito fundamental ao meio ambiente equilibrado, prenunciando uma guinada ainda incipiente na direção de um “constitucionalismo verde profundo” ou “ecocêntrico”. O cenário político e institucional ainda é muito instável e dinâmico para que se conclua pela definição de adotado um novo paradigma do constitucionalismo ecológico. Dúvidas sobre a efetividade de suas normas e o empenho do status quo econômico lançam suas sombras sobre a efetividade desse processo.
